Residents have the right to refuse to have their picture taken for any reason.  If they have chosen to refuse, you can use  a description of them in place of the picture for the MAR/TARs and elopement book. If you are totally electronic, the description of the resident can be typed and printed on a piece of paper and a picture of the paper could be taken unless you have another way to convert a text description to a jpeg file for the electronic health record.

    Hello group,

My question is regarding confidentiality or consent. When a patient expresses their wish to not have their photograph taken and placed in the EMR for concerns of identity thief; what are best practices to ensure the patients wishes are satisfied? Also is this a state provision?

    Thank you
